Terms & Conditions

1. Introduction

These Terms & Conditions ("Terms") govern your use of the TapRev platform (the "Service") provided by TapRev ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

2. Account Registration

2.1 Eligibility

You must be at least 18 years old and have legal authority to bind your business to these Terms. You must provide accurate and complete information during registration.

2.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorised use. We support email/password and Google OAuth authentication with session-based access control.

2.3 User Roles

  • Admin — full platform management including all businesses, users, plans and system settings.
  • Business Owner — manages their business's locations, units, NFC tags, pages, team and billing.
  • Business Staff — limited access as configured by the Business Owner.

3. Subscription & Billing

3.1 Plans

We offer Free, Starter, Plus and Enterprise plans. Plan features, limits and pricing are displayed on our pricing page. A 14-day free trial is available on Starter and Plus plans.

3.2 Trial

During the trial period you have full access to the plan's features. No payment is required during the trial. You must add payment details before the trial ends to continue on a paid plan. If you do not, your account will be downgraded to the Free plan.

3.3 Billing

Paid plans are billed monthly or annually via Stripe. Fees are charged in advance and are non-refundable except as required by law. You can upgrade, downgrade or cancel at any time; changes take effect at the next billing cycle.

3.4 Enterprise Plans

Custom enterprise plans are negotiated individually. Terms, pricing, limits and features are specified in a custom proposal. Contact sales for enterprise pricing.

3.5 Resource Limits

Each plan includes limits on locations, units, NFC tags, team members and analytics history. Server-side enforcement prevents exceeding these limits. The 1 Unit = 1 Guest Page relationship means your unit limit determines your maximum guest pages.

4. Acceptable Use

You agree not to:

  • Use the Service for illegal, fraudulent or harmful activities.
  • Upload content that is unlawful, defamatory, infringing or obscene.
  • Attempt to access data belonging to other businesses or bypass security controls.
  • Abuse, overload, hack or disrupt the Service or its infrastructure.
  • Use the Service to send unsolicited spam or malicious communications.
  • Reverse engineer, decompile or disassemble the platform.
  • Share your account credentials with unauthorised persons.

We reserve the right to suspend or terminate accounts that violate these terms.

5. Your Content

You retain ownership of content you upload to the Service (business information, branding, page content, images). You grant us a licence to host, store, process and display your content as needed to operate the Service. You are responsible for ensuring you have the rights to use all content you upload.

6. Public Guest Pages

Content published on public guest pages is visible to anyone who taps the associated NFC tag or scans the QR code. You are responsible for the accuracy and appropriateness of published content. We are not liable for guest interactions with your published pages.

7. Intellectual Property

The Service, including software, design, templates and branding, is owned by TapRev and protected by intellectual property laws. You may not copy, modify or distribute our intellectual property without permission.

8. Data Processing

We act as a data processor for your business's customer data in accordance with our Privacy Policy. You are the data controller and are responsible for ensuring lawful processing of any personal data you collect through the Service.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by factors beyond our control. We may schedule maintenance with advance notice.

10. Termination

10.1 By You

You can cancel your subscription at any time. Upon cancellation, your account is downgraded at the end of the current billing period. You can export your data before termination.

10.2 By Us

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or pose a security risk. We will provide notice where possible.

10.3 Effect of Termination

Upon termination, your data is retained for 90 days for recovery, then permanently deleted. Enterprise clients may have custom data retention terms in their proposal.

11. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be error-free, secure or available at all times. You use the Service at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, TapRev shall not be liable for indirect, incidental, special or consequential damages, including loss of profits, data or business interruption. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

13. Governing Law

These Terms are governed by applicable laws. Disputes will be resolved in the courts of competent jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes. Continued use after changes constitutes acceptance.
